Could a person sue political organizations for false advertising?

Posted on February 15th, 2011 by admin1 in Political Advertising

Currently in Ohio we have a vote coming up to allow or disallow casinos in state. Both sides are advertising completely different things about the prop. and stating exact opposites. It has gotten so bad that each side is saying the other is lying.
What I want to know is: Can I as an individual sue whatever side is lying about the issue under false advertising? (Or for any other reason like intentional distribution of misinformation).
Does anyone else think this would help in making decisions when it comes time to vote?

Yes you may sue either company that is giving out false advertisements. It is in the law that false advertisements are not allowed. If it is intentional distribution of misinformation, it is still false advertisement because they ""purposely"" gave out false advertisement to everyone in which you can sue the company.

I hope I have helped you =)

I think only in the case of defamation. References : http://www.expertlaw.com/library/personal_injury/defamation.html

Can you sue them? Yes. Will you be successful? No, and you’ll likely get stuck with a bill for not only your own attorney fees, but theirs as well.

The problem is that you cannot show that these campaign ads have actually caused you any damages because you have been smart enough not to rely on them. References :
